Three Recent Legal Actions Concerning the Oil and Natural Gas Industry and the Department of the Interior on Federal Royalties

The Independent Petroleum Association of America (IPAA) and BakerHostetler have partnered to offer a program to present industry with an update and analysis of three recent rulings in the federal royalties arena:

• Devon Energy Prod. Co., vacating one ONRR Director decision for failure of ONRR to issue a proper order and remanding another decision for failure of ONRR to review a lessee’s marketable condition evidence and analysis;
• Western Org. of Res. Councils, enjoining reliance on and use of recommendations from the Royalty Policy Committee; and
• Cloud Peak Energy, Inc., denying API a preliminary injunction as to the new valuation methodologies for federal oil and gas.
